    Key EU Regulations

    CSRD & ESRS

    Directive (EU) 2026/470 narrows the EU undertaking/group thresholds to more than 1,000 employees and more than €450 million net turnover. Check the financial year, national implementation and separate third-country route; the former 50,000-company estimate is not a current scope test.

    REACH (EC 1907/2006)

    Registration, Evaluation, Authorisation and Restriction of Chemicals — governs chemical substances manufactured or imported into the EU. Significant burden for chemical-handling operations.

    CLP (EC 1272/2008)

    Classification, Labelling and Packaging — implements the GHS standard across the EU. Requires GHS-compliant SDS, labels, and hazard communication.

    ATEX Directives (2014/34/EU + 1999/92/EC)

    Equipment and workplace protection in potentially explosive atmospheres. Requires hazardous area classification (Zone 0/1/2 + 20/21/22) and ATEX-certified equipment.

    Framework Directive 89/391/EEC

    Foundational EU OH&S directive — places general duties on employers for risk assessment, prevention principles, worker information, and competent OH&S service.

    GDPR (EU 2016/679)

    General Data Protection Regulation governs personal data — including incident records, training data, and occupational health information. Assess lawful basis, data minimisation, security and any additional conditions for health data. GDPR does not impose a blanket EU-hosting requirement; international transfers need an applicable legal mechanism.

    What to Look for in EU EHS Software

    ESRS-mapped reporting

    Confirm direct CSRD scope separately from customer value-chain information requests. Demonstrate the applicable ESRS version, materiality assessment, evidence controls and reporting export for the relevant financial year.

    Hosting, access and international transfers

    Map hosting, support access and subprocessors. The Commission lists adequacy decisions, standard contractual clauses and other transfer mechanisms; select and assess the applicable route with your privacy team. An EU region alone does not establish compliance.

    Multilingual UI and content

    EU operations span 24 official languages. Look for native UI translation in the languages of your workforce, not just English with Google Translate hacks.

    REACH-aware chemical management

    Chemical inventory linked to REACH registration status, SVHC tracking, exposure scenario references, and downstream user reporting.

    ATEX zone management

    For chemical, oil & gas, grain, and pharma operations — hazardous area classification linked to equipment registers, work permit zone checks, and ATEX inspection scheduling.

    Country-specific reporting templates

    Italy's INAIL, Germany's DGUV, France's CNAM, Spain's INSST — each has specific incident reporting requirements. Multi-country deployments need multi-format support.

    ArbSchG § 5 and § 6

    The Occupational Safety and Health Act requires a risk assessment of working conditions, psychological stress included, and documents showing its result, the measures set and the result of their review (§ 6). § 6 also requires the employer to record accidents in which an employee dies or is unable to work for more than three days.

    ArbSchG § 12

    Safety instruction (Unterweisung) takes place during working time: on hiring, on a change of tasks and before new work equipment or technology is used, and is repeated regularly where needed. A training record should show which trigger applied.

    BetrSichV § 14

    Work equipment is inspected by a qualified person (zur Prüfung befähigte Person) at intervals set in the risk assessment. The record must show the type, scope and result of the inspection and the inspector's name and signature, or an electronic signature for documents sent only electronically, and is kept at least until the next inspection.

    GefStoffV § 6

    The hazardous-substances risk assessment covers, among other points, the supplier's safety data sheet and the possibilities for substitution. § 6(12) requires a register of the hazardous substances used, with at least the name, classification, quantity ranges, the work areas where employees may be exposed and a reference to the safety data sheet.

    DGUV Vorschrift 2

    Sets out how employers deploy occupational physicians and safety specialists (Fachkräfte für Arbeitssicherheit), including the form of care and required qualifications. The DGUV adopted a revised model text in November 2024; the version that applies to you is the one your accident insurance institution has brought into force.

    BetrVG § 87

    Where no statute or collective agreement settles the matter, the works council co-determines the introduction and use of technical devices designed to monitor employees' behaviour or performance (§ 87(1) no. 6) and rules on accident prevention and health protection (no. 7). Plan the works agreement before rollout, not after.

    What to demonstrate. Ask each vendor to show, in German, a risk assessment with its measures and review result, an instruction record with its trigger, an equipment inspection record with the inspector's signature, and the hazardous-substances register linked to the current safety data sheet. Test the languages your workforce uses separately from the interface language.

    Platform evidence. Integration tooling, or a connector that names transfers to systems such as SAP, does not establish a ready interface: ask for the connection to be demonstrated, with licences, mappings and update ownership specified separately. German-language templates, hosting location and certifications need confirming in the proposal for whichever product you shortlist from the list below.

    Frequently Asked Questions

    Are US-built EHS platforms GDPR-compliant for EU operations?
    Assess the actual processing, access, contracts and transfer route rather than the vendor’s country of origin. The European Commission identifies adequacy decisions, standard contractual clauses and other mechanisms. Health data needs its own assessment; neither an EU hosting label nor a US vendor address decides compliance.
    Does CSRD apply to non-EU companies?
    Potentially. EU subsidiaries can have their own obligations. The separate third-country parent route under Directive (EU) 2026/470 uses EU turnover above €450 million in each of the last two consecutive years and a qualifying EU subsidiary or branch above €200 million net turnover in the preceding financial year.     Which platform best handles ESRS reporting?
    Define the applicable ESRS version, reporting period and required outputs first. Ask each provider to demonstrate its named application and the handoff from source records to disclosure. An EHS or carbon product label does not establish complete ESRS coverage; use the current CSRD comparison and the dated product evidence.
    Do I need a separate platform per country in the EU?
    No. Modern EU-focused platforms support multi-country deployments with country-specific incident reporting templates, multilingual workflows, and consolidated regional analytics. Single-platform multi-country is the default architecture.
    What's the difference between EU ATEX and US Class/Division for hazardous areas?
    Both classify explosive atmospheres but use different zone systems. EU ATEX uses Zones 0/1/2 (gas) and 20/21/22 (dust). US uses Class I/II/III + Division 1/2. Equipment is generally not interchangeable. Multi-region operations need software that handles both schemes.
    How does software help with REACH compliance?
    Strong chemical management platforms link your chemical inventory to ECHA's REACH database, flag SVHCs (Substances of Very High Concern), track exposure scenarios from supplier SDS, and produce downstream user reports when required. See our chemical management software guide.
